BGP Litigation partner Alexander Vaneev speaks with Kommersant about the lawsuit filed by PPF Management in the framework of a dispute surrounding the loss of control over Pavlovskgranit, the defendants under which include Sberbank and German Gref

"Alexander Vaneev, a partner at BGP Litigation, notes that there have been similar cases in the past: "For example, you may recall the action brought by Khan Resources against JSC Atomredmetzoloto (the mining division of Rosatom state corporation). In that case it was argued that the state-owned company had conspired with the Mongolian government to misappropriate the development license for the Dornod uranium field"".

"Mr Vaneev says the most difficult aspect of such cases is proving there was a conspiracy between the defendants: "As a rule, it is practically impossible to find conclusive proof, so it comes down to indirect evidence. Ultimately it is up to the court to make determine whether the claimant's case is convincing, including in the course of cross-examination of witnesses"".
