BGP Litigation managing director Alexey Nechaev speaks with Vedomosti about the acquisition of leading mineral water producer Arkhyz's debt to Sberbank by a company owned by Leonid and Vladislav Maevsky

"Once it becomes the principal creditor, Delta can try to take control of the bankruptcy with the aid of a trustee in bankruptcy friendly to it, who Delta itself can recommend, says Alexey Nechaev, managing director of BGP Litigation. This will help when it comes to forming auction lots, separating property that may be of interest to a buyer, and setting a price that is acceptable to it, he said".

"When a distressed asset is acquired at a relatively small discount, this attests to the buyer's confidence that its investment will be returned, says Nechaev. A strategic investor may already been found, he says: "As a rule, when purchasing distressed assets, investors are counting on a return of more than 25% per annum"".
